Zero Nicotine Vapes in Australia: What's Actually Legal in 2026

By ONEWING GROUP LIMITED · Updated 2026 · Reading time: 8 min

The most expensive misunderstanding in the Australian vape trade right now is the assumption that removing nicotine from a product makes it an ordinary consumer good. It does not. The 2024 federal reforms deliberately closed that gap, and retailers who built a stock plan around “0mg is fine” have discovered the hard way that it is not.

Zero nicotine does not automatically mean open retail.
Zero nicotine does not automatically mean open retail.

The critical thing most guides get wrong

Before July 2024, the practical dividing line in most states was nicotine content: nicotine products were therapeutic goods, non-nicotine products were treated like general merchandise in most jurisdictions, with Western Australia as the long-standing exception.

The 2024 reforms moved the line. The prohibition on general retail sale now applies to e-cigarette products regardless of nicotine content — disposable single-use devices included. Zero nicotine changes a product’s therapeutic goods status; it does not restore general retail availability.

What federal law says since 1 July 2024

From 1 July 2024, vaping products may only be supplied through pharmacy channels, with conditions attached to what pharmacists may supply and to whom. Nicotine concentration matters at the margin — lower-strength products can be supplied over the counter in most states and territories, while higher strengths and access by under-18s remain prescription-bound.

Two states go further than the federal baseline: Tasmania and Western Australia require a prescription for anyone, regardless of nicotine level. Personal importation of nicotine vaping products has been prohibited since 2024, and the reforms also tightened advertising, manufacture and commercial possession.

The framework is under a mandated independent review with a commencement deadline no later than 1 July 2027, so the detail may shift again. Treat any guide, including this one, as a starting point for verification rather than as settled law.

The state and territory layer

Federal law sets the floor; state and territory tobacco control legislation operates on top of it, covering smoke-free areas, display, advertising, licensing and sales to minors. Where the two conflict, federal law prevails to the extent of the inconsistency, but the state layer still governs most of a retailer’s daily reality.

Practical examples that catch businesses out: South Australia prohibits sale of e-cigarette products by mail, phone or internet; individual states impose differing age restrictions on pharmacy supply; and enforcement priorities vary considerably between jurisdictions. State health departments in each jurisdiction publish the current position and are the authoritative source.

Why “0mg” is not a loophole

Two separate problems, and both matter for trade buyers.

The first is legal. As above, the retail ban does not turn on nicotine content. A zero-nicotine disposable cannot be sold through general retail on the basis that it carries no nicotine.

The second is custodial. Australian testing programmes have identified products labelled as nicotine-free that contained nicotine. A retailer holding stock that is mislabelled in that way is exposed well beyond a regulatory fine: it is a supply-of-nicotine issue. Batch-level independent testing is the only reliable safeguard, and a supplier who cannot produce it should be treated accordingly.

Which categories remain open

Not everything in the trade sits behind the pharmacy counter. Hardware and accessories — batteries, chargers, coils, cases — are generally regulated as consumer electronics and are not caught by the vaping product restrictions in the same way, though dangerous goods rules still apply to the batteries themselves.

For manufacturers and wholesale suppliers such as ONEWING GROUP LIMITED, the commercially relevant channels are export markets, licensed distributors in jurisdictions where retail supply is lawful, and the pharmacy pathway inside Australia. That is a B2B supply business, not a consumer retail one — and it is the framework our trade content is written for.

Compliance checklist for trade buyers

  1. Identify the product category precisely: does it contain nicotine, and is it a disposable device, a pod system, or hardware?
  2. Confirm the position in your specific state or territory with the relevant health department, not with a supplier’s summary.
  3. Require batch-level Certificates of Analysis, including nicotine content verification for anything labelled zero.
  4. Verify your supplier’s business credentials independently — ABN, physical warehouse, traceable import records.
  5. Keep advertising and promotion clear of consumer-facing claims; the restrictions cover advertising as well as sale.
  6. Date-mark and rotate stock, and keep batch documentation with the stock it belongs to.
  7. Re-check the rules quarterly. This framework has changed materially three times since 2023.

None of the above is legal advice. It is the due-diligence routine that separates a compliant trade buyer from an expensive one.

Category by category, at a glance

Category Federal position since 2024 What trade buyers should do
Nicotine disposables / pods Pharmacy supply only; prescription rules vary by state Not available to general retail. Confirm channel legality
Zero-nicotine disposables Also caught by the retail sale ban Do not treat “0mg” as general merchandise
E-liquid and pods Restricted with the device category Determine nicotine content before sourcing
Hardware, batteries, chargers Generally consumer electronics Dangerous goods rules on cells still apply
Export and B2B distribution Governed by the destination market Compliance is a per-market question
Verify current status with the TGA and your state health authority before importing or stocking.

Frequently Asked Questions

Are zero nicotine vapes legal in Australia?

They are not available through general retail. The 2024 reforms extended the retail sale prohibition to e-cigarette products regardless of nicotine content, so removing nicotine does not restore ordinary retail availability.

Can I sell zero nicotine vapes in my shop?

Not through general retail under the current federal framework. Limited lawful supply runs through pharmacy channels, with additional conditions in some states. Confirm your specific position with your state health authority.

Why do some products labelled 0mg test positive for nicotine?

Mislabelling and inconsistent manufacturing. Australian laboratory testing has found nicotine in products sold as nicotine-free, which is why batch-level independent testing is essential rather than optional.

What can a non-pharmacy retailer legally sell?

Hardware and accessories such as batteries, chargers, coils and cases are generally treated as consumer electronics rather than vaping products, subject to normal consumer and dangerous goods rules. Device categories are the restricted ones.
