The device is not the illegal part. The channel is. Since the 2024 vaping reforms, all vapes in Australia — with or without nicotine — are regulated as therapeutic goods, and the rules turn on who supplies them, at what strength, and how they entered the country. The short answer

A 12,000-puff device is not banned as a product type. What changed is that since 1 July 2024, vapes may only be supplied through the pharmacy channel in Australia. From 1 October 2024, adults 18 and over can purchase vapes up to 20mg/mL from participating pharmacies without a prescription where state or territory law allows it; higher strengths, and supply to under-18s, require a prescription. Tobacconists, convenience stores and general retailers cannot lawfully sell them, regardless of nicotine content.

The practical consequence for high-capacity devices is that the addressable Australian market is narrower and more compliance-heavy than the shelf presence of these products might suggest.

Importation: the personal scheme is closed

The personal importation scheme for nicotine vaping products closed on 1 January 2024. As of 2026 an individual traveller or online buyer cannot lawfully import nicotine vaping products for personal use. Commercial import is restricted to therapeutic goods sponsors registered with the TGA, supplying through licensed pharmaceutical wholesalers. Australian Border Force seizures have run into the millions of units per year, so the enforcement risk is not theoretical.

Penalties are set at deterrent level

Offences under the Therapeutic Goods Act 1989 carry significant maximum penalties. In its 2026 enforcement releases the TGA has cited imprisonment of up to 7 years and fines up to approximately $2.31 million for individuals and $23.1 million for corporations per offence, with lower figures quoted in some state-facing summaries. Possession for personal use is not criminalised, but supply, import and advertising are.

Enforcement is active and continuing. The TGA has run dozens of joint operations since the reforms, including multi-site actions in south-west Sydney in April 2026 and Darwin in July 2026 that together seized tens of thousands of units and substantial quantities of nicotine pouches.
